Terms of Use

These Terms of Use ("Terms") are an agreement between you and Isabella Mercer ("I", "me"), the publisher of the Belcino Flow mobile app ("the app"). The Privacy Policy explains how the app handles data and is part of these Terms. You must be old enough to agree to these Terms where you live, or have a parent or guardian's permission.

I grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use, under these Terms and the rules of the app store you downloaded it from.

You may not copy, modify, distribute, sell or lease the app. You also may not reverse engineer it or try to extract its source code, except where the law expressly allows. All rights not expressly granted are reserved. The app, its design and its name remain my property or my licensors'.

• A route you plan in the app is a line on a map. It does not mean the path exists, is open, is legal to use or is safe in current conditions.
• Obey trail closures, private property boundaries, traffic laws and the rules of parks and protected areas.
• Do not handle your phone while riding or in situations where it would distract you from hazards.
• Do not rely on the app in an emergency. Contact your local emergency services.

Map data may be incomplete, outdated or wrong. GPS positions can drift or drop out under tree cover, in canyons, near cliffs, or when battery-saving settings or permissions limit location access. Recorded distance, time and track shape are estimates. Your phone's operating system can also pause or stop a recording, for example when the battery runs low.

Maps that were never loaded on your device may not be available without a signal. Check before you leave.

The routes you plan and the tracks you record belong to you. They are stored on your device and are not uploaded to me. That also means you are responsible for keeping them: deleting the app, losing or resetting your phone, or a device failure may permanently erase them. I cannot recover data I never received.

If you export or share a route or track, you decide where it goes and you are responsible for that sharing.

You agree not to use the app:

• in breach of any law, or to track another person without their knowledge and consent;
• to interfere with, disrupt or overload the app or any service it connects to;
• to scrape or bulk-download map data in a way that breaks the map provider's terms.

The app may show map imagery from third-party providers and is distributed through Apple's App Store or Google Play. Those services have their own terms, and I am not responsible for their content, availability or practices. Apple and Google are not parties to these Terms and have no obligation to support the app. Where the store's standard terms require it, those terms also apply to you, and the store operator is a third-party beneficiary of these Terms.

The app is provided "as is" and "as available", without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. I do not warrant that the app will be uninterrupted, error-free or accurate, or that it will meet your needs.

To the fullest extent allowed by law, I am not liable for any indirect, incidental, special, consequential or punitive damages. I am also not liable for personal injury, property damage or loss of data arising from your use of the app, or from relying on any route, map or recording. My total liability for any claim relating to the app is limited to the amount you paid for it, if anything.

Some places do not allow certain exclusions. Where that is the case, these limits apply only as far as the law permits. Nothing in these Terms limits liability that cannot legally be limited.

I may update the app, change or remove features, or revise these Terms. The effective date at the top will change when I do. If you keep using the app after a change, you accept the revised Terms. You can stop at any time by deleting the app. If you breach these Terms, your licence ends automatically.

These Terms are governed by the laws of the country where the publisher is based, without regard to conflict-of-law rules. Mandatory consumer protections where you live still apply. If any part of these Terms is found unenforceable, the rest stays in effect.
